The position
The Privacy Counsel is integral to the development, maintenance, and enhancement of FourKites’ data privacy program as it evolves with the business. This role will report into the General Counsel and be responsible for advising multiple levels of the organisation on laws, regulations, and industry best practices concerning data privacy. Most importantly, they will facilitate the translation of those requirements into day-to-day operations and transactions.
Tasks & responsibilities
- Develop, mature and scale FourKites’ global privacy program to continuously improve our data privacy and data governance programs as FourKites expands into new countries.
- Conduct or oversee legal research. Interpret and apply a risk-based assessment of how legal requirements affect new services, offerings, projects, products, or initiatives.
- Educate and partner with Product & Engineering teams to ensure privacy policies are correctly implemented and that new product offerings meet our privacy and data protection requirements (including data privacy by design).
- Advise the Marketing and Sales teams on privacy implications of core activities (customer-facing communications, advertising, FAQs etc).
- Advise HR teams on privacy requirements in various countries where FourKites has people and resources.
- Advise other appropriate stakeholders on compliance matters across all aspects of U.S. and international privacy and data protection laws and regulations.
- Conduct DPIAs, maintain article 30 record and update and create other privacy program documentation as required.
- Draft and negotiate privacy and data protection agreements with our customers, partners and vendors (e.g., SCCs and DPAs for SaaS and partnership agreements).
- Support the implementation customer-facing privacy policies and related communications.
- Keep the organisation abreast, and advise on the potential business impact, of new, pending or proposed federal, state, and foreign legislation, rules and regulations, as well as industry developments and trends, related to privacy, data security, and information governance that may affect the company and its operations.
- Devise training and communications materials to promote a culture of data protection compliance across all business groups.
- Support ongoing data governance initiatives and aid the maturity of the privacy program.
Candidate profile
- Minimum of five years of data protection compliance experience, with specific experience having implemented a GPDR-compliant data privacy program in a complex, multinational corporation.
- Subject matter expertise in European and international data protection laws and practices, including an in-depth understanding of GDPR, CCPA requirements and with perspective and insights into evolving global privacy laws.
- Insight and understanding of security and cyber issues and the ability to converse technically with other security and engineering professionals.
- Growth mindset, intellectual curious and professional drive.
- Exceptional interpersonal and communication skills, including the ability to connect with, and gain the respect of, stakeholders at all levels and across departments, including our executive team
- Ability to deal with ambiguity, including functioning well in loosely structured situations involving uncertainty or lack of information and being open to and responding flexibly to change
- Ability to interpret and comprehend complex legal documents and ability to convey complex legal issues in clear and concise business terms
- Ability to prioritise work flow, work independently and efficiently
- Strong and effective professional communication skills, both written and verbal
- Detail-oriented with excellent legal judgement, strong organisational skills and proven ability to deliver creative, thoughtful, and business-oriented results
- Ability to solve problems in a diplomatic, approachable, and practical manner.
Education Experience:
- J.D. or European Law degree or from an accredited law school, distinctive academic record
- Privacy experience gained at a leading law firm or in-house (ideally at or advising a global SaaS or other technology company)
- Fluency in English
